Negative Social Media comments which you suspected was by one of your own employees - how to proceed as an employer?
With today’s internet age and use of Facebook and Twitter widely used from both a personal and business perspective, there are many advantages. However, what will you do as an employer if you found negative comments which you suspected was by one of your own employees? This may invovle detailing incidents or situations that have occurred at work, comments made about a manager, the owner of the business or if pictured in an activity. The impact on the business's reputation could be major.
You should act quickly to collect evidence and identify the author, before taking action to have the comment removed.
You may feel it’s appropriate to claim damages for defamation. However, the likely course of action may be disciplinary action against the employee who posted the comment. Assuming the matter may be potentially serious and employment terminated, it’s important to follow the correct dismissal process to avoid any potential unfair dismissal claim.
